TERMS OF USE AND SERVICE FOR VOLUNTEERS

Please read these terms of use and service (Terms) carefully before using the GoVo platform.

What is GoVo?

GoVo is a new digital volunteering platform being developed by Royal Voluntary Service which is available as a progressive web app (PWA) and at govo.org and go-vo.org (GoVo). It is being funded thanks to support from players of People's Postcode Lottery.

The aim of GoVo is to grow volunteer participation across Britain and support volunteers in finding volunteering opportunities with charities registered to use GoVo. It will aim to do this in a way that reduces obstacles to taking up volunteering opportunities and presents a "frictionless" route to volunteering for all.

GoVo will use digital solutions to enable you to apply for volunteering opportunities in which you are interested. This will include the facilitation of a verified digital ID performed by our third-party service provider, Yoti Limited (Yoti); the result of which will (at your discretion) be shared with organisations seeking volunteer support.

What's in these Terms?

These Terms contain the rules applicable to volunteers using GoVo.

It is intended that from initial launch additional and/or revised functionalities will be developed from time to time, with a view to include the development and use of "volunteer passports" on GoVo. Consequently, these Terms and Privacy Notices will be updated from time to time to reflect the implementation of those additional functionalities.

We reserve the right to amend these Terms at any time. Any amendments will be posted on govo.org and go-vo.org and you are responsible for checking these Terms each time you use GoVo.

Who we are and how to contact us

govo.org and go-vo.org are sites operated by Royal Voluntary Service (we, us, our, RVS). We also operate the PWA (further details of which are provided below). We are a charity registered in England and Wales with charity number 1015988, and a registered company limited by guarantee, with number 2520413. Our registered office is at Hanley Centre, 29 Charles Street, Stoke-on-Trent, Staffordshire ST1 3JP.

By using our site and/or the PWA you accept these Terms

By using GoVo, you confirm that you accept these Terms and that you agree to comply with them.

If you do not agree to these Terms, you must not use GoVo.

We may update and change GoVo from time to time. We will try to give you reasonable notice of any major changes.

We may suspend or withdraw access to GoVo

We do not guarantee that GoVo, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of GoVo for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

Please note that we may also suspend or withdraw your access to GoVo, without notice to you, if you do not comply with these Terms (or any part of them).

We may transfer this agreement to someone else

We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms.

Creation of an account

To create an account on GoVo you must be at least 14 years of age and resident in England, Scotland or Wales. By registering to create an account on GoVo, you confirm that you satisfy these age and residency requirements.

When you create an account on GoVo or apply for a volunteering opportunity you agree that these Terms, our Privacy Notice and the GoVo Cookie Notice , apply to you.

To create an account on GoVo you must complete our online registration process available at govo.org and go-vo.org. When you create an account, we may require you to provide us with certain information to verify your eligibility to set up an account and use GoVo. You are fully and solely responsible for providing honest and accurate information. We will decide whether to approve or reject your account and no account will be opened for you, unless we have approved it.

Your account is for personal use only and must not be used for any business use. We are not responsible if your email is used improperly or falsely by a third party. You may request us to disable your account at any time by contacting us. Where you do this, we might need to hold certain records relating to your account to comply with our obligations under law.

You must not attempt to impersonate another user or person when creating an account on GoVo or otherwise, when using GoVo. If you do so, or use false information or we have reason to believe you are doing so, we shall have the right to withdraw your account access and/or to disable your account, to report you to the relevant authority or agency, or to take such other action as we in our discretion believe is necessary for the protection of our users and/or our business or reputation.

You must keep your account details safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not share this information with any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if we believe you have failed to comply with any of the provisions of these Terms or our policies.

If you know or suspect that anyone other than you, knows your user identification code or password, you must inform us immediately by emailing us at help@govo.org.

Our rights to disable your account

We reserve the right to disable your account if you:

We shall have no liability to you for any loss, distress or inconvenience incurred, as a result of your account being disabled.

What is a progressive web app

The PWA is not a native app, but if you install it, it will provide you with the same visual experience of a native app. When accessing either of our sites you will be provided with the option to install the PWA on to your device. Once installed, the PWA will provide an icon on your device, which can be launched as a standalone app.

How you may use material on our site

For the purposes of these Terms, we own or are the licensee of all intellectual property, know-how, trade knowledge and other confidential information in or arising out of or in connection with GoVo. You must not do any of the following:

Although we make reasonable efforts to update the information on GoVo, we do not guarantee that the content on our platform is accurate, complete or up to date.

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to GoVo or any services provided via, or in relation to, GoVo for any purpose. This includes using (or permitting, authorising or attempting the use of):

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

Rules about linking to GoVo

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to GoVo in any website that is not owned by you.

We reserve the right to withdraw linking permission without notice and you must remove any link as soon as we ask you to.

If you wish to link to or make any use of content on GoVo other than that set out above, please contact us.

Our trade marks

You must not under any circumstance use the "GoVo" trademark without our prior written approval.

How you may use material on our site and the licensing of your content and intellectual property

Whenever you make use of a feature that allows you to upload any text or pictures to GoVo, (e.g. as part of your profile) or to raise a question, or otherwise make an enquiry using our chat bot facility, you must comply with the standards set out below.

You confirm that your content complies with the above standards. You will be liable to us for any loss we incur, if it does not.

We will consider any content you upload to GoVo to be non-confidential and not protected by any trade mark, patent or copyright ("non-proprietary"), that is, in the public domain. You own your content, but you are required to grant us and other users of GoVo a limited licence to use, store and copy that content and to distribute and make it available to others.

We also have the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to GoVo violates their intellectual property rights or their right to privacy.

We have the right to remove any content you post on GoVo if, in our opinion, your content does not comply with the acceptable use standards set out in these Terms.

If you wish to contact us in relation to content you have uploaded to GoVo and that we have taken down, please contact us on help@govo.org.

When you upload or post content to GoVo, you grant us the following rights to use that content:

User-generated content is not approved by us

GoVo may include information and materials uploaded by other users and particularly other volunteers and charities. This information and these materials, have not been verified or approved by us. The views expressed by other users and charities do not represent our views or values.

Any information provided by a charity and/or volunteering organisation as part of a listing or otherwise shared on GoVo is not verified or approved by us, and we are unable to confirm whether such information is accurate or up to date. We will have no liability to you for any outdated or incorrect information shared by or a charity, volunteering organisation, or other user of GoVo.

Your relationship with a charity and/or a volunteering organisation

The charity and/or volunteering organisation that engages you to perform a volunteering role or an activity, will be entirely responsible for your conduct, actions, wellbeing, health and safety, induction, safeguarding, training and supervision, whilst you are performing that volunteering role and/or activity. We will have no responsibility and will not accept any liability for the performance of your obligations in respect of the volunteering role or activity and/or the charity's and/or volunteering organisation's dealings with you (including without limitation, your health and safety whilst performing a volunteering role or activity).

Responding to listings and corresponding with charities

You are responsible for choosing what opportunity (if any) to apply for. Our search parameters on GoVo do not suggest your suitability for the advertised opportunities.

By applying for or responding to a listing on GoVo we do not guarantee that you will receive a response from the charity or volunteering organisation or, that you will be offered the advertised role. It is entirely up to the charity or volunteering organisation to decide who to offer the role to. We also do not guarantee delivery or your receipt of a charity's or volunteering organisation's emails, or that there will be no mistakes in the transmission or storage of the data. You are responsible for checking your account to view your applications and other information.

Any information you provide to a charity and/or volunteering organisation and/or add to your account profile (including, without limitation, information about your qualifications and experience) must be complete and accurate. We assume no responsibility for the communications between you and any charity and/or volunteering organisation.

GoVo does not provide an inbuilt messaging function for you to correspond with a charity or volunteering organisation via the GoVo platform. Charities and/or volunteering organisations will arrange to correspond with you outside of the GoVo platform, should they wish to proceed with your application or registration of interest in a particular volunteering role or activity.

Yoti's digital identification service

GoVo facilitates the use of Yoti’s digital identification service. This allows you to verify your identity with Yoti and for Yoti to notify us that you have verified your identity with them. After you have created a GoVo account, we will share that notification with the charity and/or volunteering organisation you choose to undertake an activity with. If you have previously registered with Yoti, you are likely to be able to use your existing verified identity, as stored in your wallet on the Yoti app, to support your volunteering activities via GoVo. If you are not registered with Yoti, GoVo will provide you with a QR code which will take you to Yoti to complete an identity verification process. You agree to provide true, complete and accurate details to Yoti, as requested by them. Once verified by Yoti, you will have the option to share additional information about your Yoti identification process with a charity and/or volunteering organisation with which you are interested in volunteering. If this information is requested by a charity or volunteering organisation, please note it will be your choice as to whether you choose to provide them with the additional information. If you choose not to share the additional information with the requesting charity or volunteering organisation, then it is possible that the charity or volunteering organisation may not be able to progress your application for a volunteering role or opportunity. Please be aware that under English, Welsh and Scottish law, it is a criminal offence to create, possess and/or use fraudulent, forged, false or improperly obtained documentation. It is illegal to impersonate, or pretend you are, someone else, for example by using their identification documents. If we know of or suspect activity by you that contravenes this section, we reserve the right to disable or suspend your access to your GoVo account, to report you to the relevant authority or agency, or to take such other action as we in our discretion believe is necessary for the protection of our users and/or our business or reputation, and we will keep a copy of your data for further anti-fraud procedures or as may be required by law. If false or inaccurate information is provided and fraud is identified, details may be passed to fraud prevention agencies to prevent fraud, money laundering and other criminal offences. We are not responsible for websites we link to

Where GoVo contains links to other sites and resources provided by third parties (including but not limited to Yoti), such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources and shall not be liable for your use of those sites or resources.

We are not responsible for viruses

We do not guarantee that our platform will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform to access GoVo. You should use your own virus protection software.

You must not introduce viruses

You must not misuse our platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our platform or any part of it. You must not attempt to gain unauthorised access to our platform, the server on which our platform is stored or any server, computer or database connected to our platform or any other equipment or network connected with our platform. You must not interfere with, damage or disrupt any software used in the provision of our platform or any equipment or network or software owned or used by any third party on which GoVo relies in any way. You must not attack our platform via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use GoVo will cease immediately.

Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms (except those which cannot be excluded by applicable law) that may apply to our site or any content on it.

We aim to ensure that you are able to access and use GoVo at all times. However, your use of GoVo may from time to time be interrupted by maintenance, repairs or updates or other factors which we may not be able to control and we cannot guarantee to you that they will always be available. We will do our best to notify you of such situations as soon as possible after we become aware of them, but we will not be liable under any circumstances for any loss or damage caused as a result of such interruption of availability of GoVo, other than as set out below.

Aside from the circumstances listed above, if we do not comply with these Terms, we will be responsible for loss or damage you suffer that is a foreseeable result, to you and to us, of our breach or our negligence (that is, any act or omission by us which falls short of a standard to be expected of a reasonable person) up to a total cap of £500 (to the extent permitted by law). This cap includes all claims whether made for a breach of contract, our negligence or for any breach of our statutory duty.

We are not responsible for any other loss or damage you suffer that is not reasonably foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by both you and us at the time you crated an account on GoVo. To the extent permitted by law, we are not responsible for any loss whatsoever due to the actions of third parties (including bad actors) that were not made possible by our own negligence.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with your inability to use GoVo.

You have legal rights where we do not provide services with reasonable care and skill. Information about your legal rights is available from your local Citizens' Advice Bureau. Nothing in these terms and conditions will affect these legal rights.

Data protection

We will be processing your personal data in the context of the creation of an account on GoVo. We are controllers of your personal data.

Complaints

If you have any complaints about a charity's or volunteering organisation's services, volunteering opportunities, or their dealings with you, you must raise your complaint with that charity or volunteering organisation, and they will address your complaint in line with their own policy.

If you have any complaints about Yoti, their service and or platform, you must raise your complaint with Yoti, who will address your complaint in line with their own policy.

Which country's laws apply to any disputes?

These terms of use and service, their subject matter and formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

GoVo will use digital solutions to enable potential volunteers to apply for volunteering opportunities in which they are interested. This will include the facilitation of a verified digital ID for potential volunteers undertaken by our third-party service provider, Yoti Limited (Yoti); the result of which will (at the discretion of each volunteer) be shared with organisations seeking volunteer support.

The expectation is that you will accept the result of any identification check performed by Yoti on a volunteer, without needing to undertake your own identification checks on that volunteer. It is intended that this will help make the route to volunteering quicker and easier.

GoVo will be available to charities registered with The Charity Commission or The Scottish Charity Regulator (OSCR) and those invited (in our discretion) to join GoVo. We welcome expressions of interest to join GoVo from organisations which are not registered with The Charity Commission or the OSCR. To register your interest to use GoVo, please contact us at help@govo.org. We use the word "charity" in these Terms to describe all those using GoVo as set out in these Terms.

We may transfer this agreement to someone else

We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these Terms.

Creation of an account and linked accounts

When you create an account on GoVo or post volunteering opportunities you agree that these Terms and our Privacy Notice and the GoVo cookie policy, apply to you. You also represent and warrant that you have all appropriate and up to date policies in place, as required by applicable law and regulation.

To create an account on GoVo a charity user must be registered with The Charity Commission or The Scottish Charity Regulator (OSCR) or invited to join GoVo by us. When you create an account, we may require you to provide us with certain information to verify your eligibility to set up an account using GoVo. The discretion to approve an account opening request shall at all times remain with RVS and we may reject any request to set up an account in our discretion.

When you access or use GoVo in your capacity as an employee or other representative of a charity, or if you create an account on behalf of a charity, you represent and warrant that you have the authority to bind the charity to these Terms. When you create an account on behalf of a charity, the account belongs to the charity, and you acknowledge that any and all information that you provide us with through the account, such as the actions you take and when you take them, will be visible to the charity.

A charity's account is for business use and not for personal use. We are not responsible for and disclaim all liability if your email is used improperly or falsely by a third party. You may request us to disable your account at any time by contacting us. Please note we may be required to preserve certain records pertaining to your account to comply with our obligations under law.

In some instances, you or one of your users may be permitted to use one account with two different profiles (a personal profile, and a corporate profile). Where this is permitted, please note that if you or one of your users breach the Terms either in your or their personal capacity or under the terms of your or their corporate engagement, we shall have the right (without prior notice to you or the user, and without liability) to suspend and/or withdraw your and/or the user's access to GoVo for both profiles.

In some instances, multiple users may be linked to the same account (Linked Account). A Linked Account is created when the primary account owner (Admin) of a charity's account invites other users to the same account. The Admin can provide these other users with access to the charity's account, but under an individual login. When using a Linked Account, each user will have access to all account information stored within the charity's account and by permitting the registration of a Linked Account, the Admin hereby authorises the sharing of that information with the Linked Account user. The Admin may visit their account settings at any time to unlink any particular Linked Account.

You must keep your account details safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. For Linked Accounts, users must set up individual passwords to access the Linked Account.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms .

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us by emailing us at help@govo.org

Our rights to disable your account and/or a user's access

We reserve the right to disable your account (including the right to disable both personal and corporate profiles, if you have them), a Linked Account, and/or a particular user's access to the account, should you or any user:

We shall have no liability to you for any loss, distress or inconvenience incurred, as a result of the account, a profile, a Linked Account or a user's access being disabled.

What is a progressive web app

How you may use material on our site and the licensing of your content and intellectual property

As between you and RVS, all intellectual property rights in GoVo and in the material published on it, whether or not registered and including applications to protect or register such rights, shall be owned by RVS (other than intellectual property rights in any materials you provide).

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged (except where the content is user-generated).

Save as expressly permitted in these Terms, you must not use any part of the content on our site for commercial purposes without obtaining a prior written licence to do so from us or our licensors.

Although we make reasonable efforts to update the information on GoVo, we make no representations, warranties or guarantees, whether express or implied, that the content on our platform is accurate, complete or up to date.

When you upload or post content to GoVo, you grant us the following rights to use that content:

You also grant us a worldwide, non-exclusive and royalty-free licence to use the name and logo of your charity in connection with the service provided by GoVo and to promote and/or advertise the charity's association with GoVo. This licence shall expire when the charity ceases to hold an account on GoVo.

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to GoVo or any services provided via, or in relation to, GoVo for any purpose. This includes using (or permitting, authorising or attempting the use of):

Our trademarks

You are permitted to use the "GoVo" trademark solely and strictly for the purposes of promoting GoVo and your charity's association with RVS and GoVo. Save as expressly provided above, you must not under any circumstance use the "GoVo" trademark without our prior written approval. We reserve the right to withdraw your licence to use the "GoVo" trademark at any time in our absolute discretion and you must stop using it immediately on receipt of written notice from us to do so.

Uploading content on to GoVo

Whenever you make use of a feature that allows you to create content directly on GoVo, upload or share content to GoVo, make contact with other users of GoVo (such as volunteers) or to raise a question or otherwise make an enquiry using our chat bot facility you must comply with the standards set out below. You should do your best to populate every required field when posting a listing and, where relevant, add a picture. We may provide a photobank of pictures that can be used by you, should you wish to do so.

You must not advertise any volunteering opportunity that is or could be deemed a substitution for an employed role. Where you do so, we have the right to remove that post and/or suspend or terminate your access to GoVo.

As volunteers must be at least 14 years of age to use GoVo and/or to apply for a volunteering opportunity or activity, you must not advertise, and you hereby agree not to post any listing on GoVo that advertises a volunteering opportunity or activity to anyone under the age of 14.

In addition, you must not use GoVo in any way that involves the following:

You warrant that your content complies with the above standards, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

We will consider any content you upload to GoVo to be non-confidential and not protected by any trademark, patent or copyright ("non-proprietary"), that is, in the public domain. You own your content, but you are required to grant us and other users of GoVo a limited licence to use, store and copy that content and to distribute and make it available to others.

We also have the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to GoVo violates their intellectual property rights or their right to privacy.

We have the right to remove any posting you make on GoVo if, in our opinion, your post does not comply with the acceptable use standards set out in these Terms. We also reserve the right (but have no obligation to) add any content (such as a photo) to your posting.

If you close or change any volunteering opportunities that you post, you agree to promptly update such opportunities on GoVo or otherwise notify us.

User-generated content is not approved by us

GoVo may include information and materials uploaded by other users and particularly, volunteers and other charities. This information and these materials have not been verified or approved by us. The views expressed by other users and those of volunteers on GoVo do not represent our views or values.

Your obligations relating to volunteers and maintaining insurance cover

You will be entirely responsible for the conduct, actions, wellbeing, health and safety, induction, safeguarding, training and supervision of volunteers whilst they are undertaking volunteering roles and/or activities that you have listed on GoVo. You agree to comply at all times with all applicable laws, guidance and codes of practice in connection with your volunteering roles, including but not limited to such laws, guidance and codes of practice relating to working with children and vulnerable persons. You also agree to ensure that any volunteer who is under the age of 16 is supervised at all times by a parent or guardian or other appropriate authorised supervisor.

If parental consent is required before a volunteer is able to participate in a volunteering opportunity or before a volunteering opportunity can be assigned to a volunteer, you must obtain that consent from the volunteer. We will not obtain the parental consent or have any obligation to do so.

You must prior to setting up an account on GoVo and at all times whilst your account remains active:

Where a volunteering role or activity necessitates a DBS or PVG check you must perform such checks prior to the volunteer commencing performance of the role or activity. We shall have no obligation to perform the DBS or PVG checks on a volunteer and will not assume any liability for your failure to perform these checks, when required.

You undertake to indemnify us against any liabilities, costs (including reasonable professional costs), damages, expenses and/or losses which we may suffer or incur as a result of or in connection with any breach of your obligations in this section.

Response to listings and corresponding with volunteers

You agree that we may reject or remove any listing for any or no reason. By accepting a listing on GoVo we do not guarantee that you will receive any applicants or that the role will be filled. You understand and agree that it is your responsibility to refrain from posting any listing, requirement, or question that directly or indirectly discriminates against volunteers or otherwise violates applicable law. We do not guarantee delivery, your receipt of a volunteer's emails or application, or that there will be no mistakes in the transmission or storage of the data. You are solely responsible for checking your account dashboard to view volunteer applications and other information.

We may highlight to volunteers the qualifications required for an opportunity posted by you, to help the volunteer assess whether to apply for the role. We do not know a volunteer's motivation for applying to your listing and thus provide no guarantee as to the volunteer's qualifications or interest in the listed opportunity. For the avoidance of doubt, we assume no responsibility for the communications between you and the volunteer.

If a volunteer puts themself forward for a role listed by you on GoVo, it is your responsibility to liaise directly with the volunteer, should you wish to progress their application or interest in the role. You will receive an email notification advising that a volunteer has shown interest in a role, and to connect you with the volunteer . Although GoVo provides contact details for volunteers, it does not provide an inbuilt messaging function for you to correspond with the volunteer via the GoVo platform. You should therefore arrange to correspond with the volunteer outside of the GoVo platform. When you make a decision to reject or accept a volunteer's application for a volunteering opportunity via GoVo, we will notify the volunteer via GoVo of your decision.

Yoti's digital identification service

GoVo facilitates the use of Yoti’s digital identification verification service. This allows volunteers to verify their identity using Yoti. After a volunteer has created a GoVo account and Yoti has notified us that a volunteer holds a verified Yoti ID, we will share that notification with you via a green tick in GoVo. If you wish to ask the volunteer to share more information about their Yoti identification verification with you, and the volunteer agrees to provide that information, then you will be able to access the additional information through a “hub” provided by Yoti (the Yoti Hub). Volunteers that have previously registered with Yoti will (at their option) allow GoVo to receive confirmation from Yoti of their previously verified identity. GoVo will not trigger a refresh of an identity that has been previously verified by Yoti. Where a volunteer is not already registered with Yoti and chooses to use Yoti to as part of their use of GoVo, then Yoti will be triggered to complete a new identity verification for that volunteer. We are not the service provider of the Yoti Hub and have no liability in relation to its performance or accuracy. Any data shared on the Yoti Hub, and your use of it, is subject to Yoti’s terms of business. Furthermore, we will have no liability to you for the performance of Yoti’s services, accessibility of the Yoti Hub or website and/or the timely provision of identification verification by Yoti, or a volunteer. In the event that you have a query or complaint regarding Yoti’s services, please liaise with Yoti directly. Their website and further information surrounding their services and the digital identification wallet can be found at https://www.yoti.com/business/digital-id/. Whilst we will use the name, date of birth and country of residence details provided by a volunteer to assess their eligibility to use GoVo and to cross check the name and date of birth provided by Yoti and by a volunteer applicant in Yoti, we will not at any time, or under any circumstance, otherwise check or validate the volunteer’s credentials or data. We take no responsibility or liability for the data provided or shared by the volunteer and/or the accuracy or completeness of that data.

We are not responsible for websites we link to

Where GoVo contains links to other sites and resources provided by third parties (including but not limited to Yoti), such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources and shall not be liable for your use of those sites or resources.

We are not responsible for viruses

We do not guarantee that our platform will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform to access GoVo. You should use your own virus protection software.

You must not introduce viruses

You must not misuse our platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our platform or any part of it. You must not attempt to gain unauthorised access to our platform, the server on which our platform is stored or any server, computer or database connected to our platform or any other equipment or network connected with our platform. You must not interfere with, damage or disrupt any software used in the provision of our platform or any equipment or network or software owned or used by any third party on which GoVo relies in any way. You must not attack our platform via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use GoVo will cease immediately.

Our responsibility for loss or damage suffered by you

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms (except those which cannot be excluded by applicable law) that may apply to our site or any content on it.

We will use reasonable endeavours to ensure that Yoti will use its reasonable skill and care in verifying or authenticating items of personal data or document image(s) including identity data (Profile Data) relating to volunteers using GoVo, but we will have no liability to you, and we disclaim to the fullest extent possible under applicable laws all implied representations, warranties, conditions and terms in respect of the accuracy of any Profile Data, whether verified by Yoti or not; all Profile Data is acquired and used by you at your own risk. We are not liable to you if the data received by us from Yoti or any volunteer is inaccurate in any way and you accept and acknowledge that no Profile Data is verified or otherwise checked by us. For the avoidance of doubt, the results of any identity verification performed by Yoti is entirely dependent on the information shared by the volunteer.

We give no representation, warranty or undertaking in respect of the suitability of the Profile Data or any combination of them for any purpose whatsoever, including any decisions made or processes (whether automated or otherwise) used by you to enter into, develop, progress, suspend, terminate, reduce or end any agreement, arrangement, relationship, licence or transaction, or to provide any product, service, membership, access or other facility to any person whatsoever, all of which you undertake at your sole risk. The Profile Data, or any other products on GoVo may be used globally and in many sectors but we do not warrant that the Profile Data, or any such products will be compliant with, or make you compliant with, laws or regulations which may be applicable to you.

We aim to ensure that you and your users are able to access and use GoVo at all times. However, your and/or a user's use of GoVo may from time to time be interrupted by maintenance, repairs or updates or other factors which we may not be able to control and we cannot guarantee to you or a user that they will always be available. We will do our best to notify you of such situations as soon as possible after we become aware of them, but we will not be liable under any circumstances for any loss or damage caused as a result of such interruption of availability of GoVo, other than as set out below.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with your inability to use GoVo.

The following types of loss are wholly excluded:

Our maximum aggregate liability to you whether in contract, tort (including negligence), for breach of statutory duty, or otherwise shall be capped at £2,000.

You agree that the above limitations and exclusions of liability reflect the commercially agreed allocation of risk between the parties for the GoVo platform, taking into account its free-of-charge access, and that the above limitations and exclusions of liability are reasonable and proportionate.

We will have no liability whatsoever for the acts and/or omissions of any volunteer you appoint for a particular role. The decision to appoint a volunteer and their suitability for a particular role shall be entirely at your discretion and risk.

Data protection

We will be processing your personal data in the context of the creation of an account on GoVo. We are controllers of your personal data.

Which country's laws apply to any disputes?

These terms of use and service, their subject matter and formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
